When can i upgrade to another phone?

I've had my red lg shine since jan 18 [at&t with 2 year contract] and im already tired of it =P I want a pink or black samsung blackjack, but im not sure if i can get it because i havent had my lg shine for a long time. when can i upgrade to another phone? and does it really matter how long you've had the old one?
